These General Terms and Conditions apply to all agreements concluded with the company D&R BetriebsGmbH (hereinafter referred to as the Little Suite Apartments).
Terms and conditions negotiated in individual cases may be added to these General Terms and Conditions. These General Terms and Conditions are displayed clearly in a generally visible position in the apartments and can also be found on our website.
2. Conclusion of the Rental Agreement for a Holiday Apartment
2.1. The decisive factor is the current price, which may vary according to the season and occupancy rate. Any other services and rates are subject to change. The rental agreement (guest accommodation agreement) can be concluded in writing, orally, by telephone or by conclusive behaviour. The conclusion of the guest accommodation agreement commits both contractual partners to fulfil the agreement regardless of the period of time for which the agreement is concluded. In the case of overnight stays in our apartment, the guest accommodation agreement is concluded as soon as the room is booked.
2.2. Customers undertake to immediately check the correctness of the booking confirmation that they receive and to inform the Little Suite Apartments of any incorrect information or deviations where applicable. Notifications of incorrect information or deviations that are received after a period of three days after receipt of the booking confirmation can no longer be considered. Incorrect information or deviations that are reported after this deadline in particular shall not entitle customers to withdraw from the agreement.
3. Bookings
Reserved rooms that have been confirmed by the Little Suite Apartments will be made available from 3:00pm onwards on the day of arrival and must be vacated by 11:00am on the day of departure. The Little Suites Apartment Hotel is authorised to allocate reserved rooms to other guests on the day of arrival after 6:00pm unless a later time of arrival was expressly agreed.
4. Price Changes
The Little Suite Apartments is authorised to change agreed prices according to the valid price lists after an agreement has been concluded if the period between the conclusion of the agreement and the performance of
Little Suite Apartments.
5. Terms and Conditions of Payment
Unless other terms and conditions of payment are agreed, invoices must be fully paid in advance without any discount. Invoices can be paid via instant bank transfer, PayPal or credit card. In the case of delayed payment due to fault reports on the part of the bank, the Little Suite Apartments is authorised to cancel the booking.
The personal details recorded in the registration form, for example a person’s name, address and, where applicable, credit card number, sort code and/or account number, are encrypted using SSL technology. This encryption process converts the details entered into a code so that the data cannot be read by unauthorised parties when transferred online.
6. Cancellations and Cancellation Fees
If guests cancel their reservations or do not use the services provided by the Little Suite Apartments, guests will be charged the following fixed rates for contractual services that are provided by the Little Suites Apartment Hotel as booked and reserved by the guests but are not used by the guests:
Cancellation until 7 days before the services are performed: no charges
Cancellation after 6 days before the services are performed: a charge totalling 100% of the price of the services booked
If guests do not use the services by not travelling to the hotel without cancelling the services in advance: a charge totalling 100% of the price of the services booked.
The cancellation fees listed above will also be charged if the booked services are only partially cancelled by guests. In this case, the fixed rates specified will apply to the parts of the services that were cancelled. The cancellation fees will also be charged if guests do not use the services booked without expressly cancelling these services.
8. Liability
Articles 701-703 of the German Civil Code (BGB) apply to the liability of the Little Suite Apartments (as a trademark of the company D&R BetriebsGmbH). Liability for other reasons is excluded unless the damage was caused by the Little Suite Apartments, its legal representatives or its agents on the basis of intent or gross negligence.
9. Withdrawal by the Little Suites Apartment Hotel
The Little Suite Apartments is not permitted to unilaterally withdraw from the concluded agreement. Exceptions to this rule are: force majeure or strikes.
Force majeure includes damages to essential utilities such as heating and sanitary facilities and damages to the hotel building that were not caused by the operators of the apartments. In the case of an emergency or breakdown, the Little Suite Apartments is entitled to withdraw from concluded guest accommodation agreements without covering replacement costs.
10. Other Provisions
10.1. Theft/Robbery by uninvolved third parties or external individuals:
Once guests have been provided with the door code, which is also used for the exterior door, the Little Suite Apartments assumes no liability whatsoever for theft or vandalism if the exterior door was not properly locked by the guests. Once they have received the code from the Little Suite Apartments, guests must close the exterior doors when they leave their apartment. In the case of intentional or grossly negligent non-compliance with the rule that guests must close exterior doors, guests may be held to account for any damages incurred by the Little Suite Apartments. Any damages caused to the fixtures, fittings or furnishings of the hotel by the guest or tenant must be reported to the owner of the Little Suite Apartments by the guest or tenant. The guest or tenant must bear the repair costs. This does not apply to general wear or general repairs to the fixtures, fittings or furnishings of the hotel, for which the hotel is responsible.
10.2. The disclosure of codes provided by the Little Suite Apartments to uninvolved third parties or unknown individuals is prohibited.
10.3. Items or objects that are the property of guests and located in vehicles in the car parks are not replaceable by means of the general provisions of the General Terms and Conditions of the Little Suite Apartments.
The operator is not liable for these items or objects. The Little Suite Apartments also assumes no liability for any private belongings, items or objects that guests leave outside of the lockable guest rooms, namely in the garden, in the courtyard, on the terrace or in their vehicle.
The Little Suite Apartments assumes no liability for damages caused by branches or trees that fall on parked vehicles in parking areas opposite the hotel.
All guests can access our General Terms and Conditions and view the design and fixtures and fittings of the apartments (in photographs) on our website.
The law of the Federal Republic of Germany applies to these terms and conditions and to all legal relations between the Little Suite Apartments and its guests.
Other than the guidelines of German legislation, these General Terms and Conditions of the operator of the Little Suite Apartments apply exclusively in all cases.
Severability Clause
If an individual provision of this agreement is or becomes invalid or the agreement contains a gap that needs to be filled, this shall not affect the validity of the remaining provisions. Invalid provisions or gaps must be replaced with a provision that is close to the economic purpose of the agreement and would have been agreed by the parties if they had been aware of the invalidity of the provisions.
The court of jurisdiction for the Little Suite Apartments is the District Court of Dresden, Germany.
